A BILL to amend article thirteen, chapter eight of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, by
adding thereto a new section, designated section eleven-a,
relating to permitting municipalities to assess taxes and levy
fees subject to local referendum.
Be it enacted by the Legislature of West Virginia:

That article thirteen, chapter eight of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
eleven-a, to read as follows:
ARTICLE 13. TAXATION AND FINANCE.
§8-13-11a. Municipalities may levy any tax or assess any fee not
prohibited by the constitution if first approved by
a municipal referendum.

In addition to other taxing authority previously granted, any municipality may levy any tax or assess any fee not specifically
prohibited by the state's constitution: Provided, That the tax or
fee is first approved by a municipal referendum.

NOTE: The purpose of this bill is to authorize municipalities
to assess any tax or levy any fee not prohibited by the
constitution, so long as it is first approved by a municipal
referendum.
